2) Benky DID make the model. It might be inspired from another model but he did make it.
3) If someone who didn't make a helm claims to have made a helm, how does that make the helm a bad model? OH, it doesn't. The person who made the model has nothing to do with the model being a good or a bad model. At least not in the way you put it.
